Welcome to MyPeaks, the mobile application designed for and by mountaineers. MyPeaks provides a platform for mountaineers to share their mountain expeditions, plan future treks, connect with guides, track their statistics, and find relevant rental shops. These Terms of Service ("Terms") govern your access to and use of MyPeaks.

By creating an account or by using MyPeaks, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use MyPeaks.

You may create an account by providing your email address and date of birth and by verifying your email address. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

Users are required to provide accurate and up-to-date information when using the app. Users must respect other users and refrain from any behavior that could be considered harmful, offensive, or illegal. Any misuse of the app may result in account suspension or termination.

You agree to use MyPeaks in compliance with all applicable laws and regulations. You will not post content that is:
•    Illegal, defamatory, obscene, or otherwise objectionable.
•    Infringing on the intellectual property rights of others.
•    Contains advertising without clearly identifying it as such. MyPeaks reserves the right to remove content at its sole discretion.

As a developing app, MyPeaks may experience bugs and errors. While we strive to provide a seamless experience, we cannot guarantee that the app will always function without issues. We are not liable for any damages arising from the use or inability to use the app. Users acknowledge that they use the app at their own risk and that we are not responsible for any loss of data or other damages.

Furthermore, all activities such as climbs, expeditions, treks, guide bookings, gear rentals, and organized expeditions are the sole responsibility of the user and/or the respective service provider. MyPeaks is not liable for any disputes, issues, or accidents arising from these activities. Users are always responsible for their own actions during such activities.

Purchases of subscriptions and other in-app items within MyPeaks are processed via the Apple Store and Google Play. All financial transactions—including billing, discounts, cancellations, and refunds—are managed by the respective platforms in accordance with their policies. While MyPeaks is committed to assisting you with any issues that may arise, subscription management is subject to the terms and conditions of your payment provider. If you have concerns regarding your subscription, please contact the support team of the respective platform.

You may delete your content at any time, which will result in its permanent removal from our databases. You may also delete your account, which will remove all associated data. We reserve the right to terminate or suspend access to MyPeaks immediately, without prior notice or liability, if you breach these Terms.

In the event of a dispute, both parties agree to first attempt to resolve the issue through informal negotiations. If a resolution cannot be reached, any dispute shall be submitted to binding arbitration in accordance with the rules of the Netherlands Arbitration Institute. Arbitration will take place in the Netherlands and be conducted in Dutch or English. By using MyPeaks, you waive your right to participate in class-action lawsuits against MyPeaks.

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

MyPeaks may include advertisements and offer paid commercial opportunities for guides, rental shops, and travel organizations. All commercial transactions are handled outside of the application.
